Habitly Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Habitly mobile application ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not install or use the Application.

Habitly is developed, published, and maintained by SMSRam ("we", "us", or "our").

2. Permitted Use & License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Habitly for personal, non-commercial productivity and habit tracking purposes on compatible devices that you own or control.

You agree not to:

  • Reverse engineer, decompile, or disassemble binary distributions of the application except to the extent permitted by applicable open-source licenses.
  • Use the application in any manner that violates applicable local, national, or international laws or regulations.
  • Interfere with or disrupt the operation of the application or associated networks.

3. Nature of the Application & Disclaimers

Habitly is a personal self-management and habit-tracking utility designed to assist users in monitoring their own daily routines. Habitly is not a medical, psychiatric, fitness, or healthcare provider.

The application, its content, streak statistics, and notification reminders are provided for informational and self-tracking purposes only. They should never be treated as medical advice, clinical diagnosis, or a substitute for professional healthcare consultation.

4. Data Storage & User Responsibility

Habitly operates on a local-first architecture. Your habits, schedules, and completion logs are stored directly on your physical device. As a user, you acknowledge and agree that:

  • You are responsible for maintaining backups of your data. While Habitly provides Google Drive cloud backup functionality, SMSRam is not responsible for data loss arising from device damage, OS reinstalls, accidental clearing of application storage, or forgotten credentials.
  • You are responsible for ensuring your device settings (such as battery optimization exemptions) allow exact alarm notifications to fire reliably.

5. Third-Party Services (Google Drive)

Habitly includes an optional feature allowing you to connect your Google account to back up and restore application data to your personal Google Drive storage using the https://www.googleapis.com/auth/drive.file scope.

By using this feature, you acknowledge that your use of Google Drive is subject to the Google Terms of Service and Google Privacy Policy. We are not responsible for Google service availability, API rate limits, or network interruptions affecting Google Drive operations.

6. Intellectual Property

The Habitly name, logo geometry (Habitly.svg), color tokens, visual designs, and associated documentation are the intellectual property of SMSRam. Third-party open-source components utilized within the project remain the property of their respective authors under their respective open-source licenses.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT HABITLY WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM BUGS, VIRUSES, OR OTHER HARMFUL CODE, OR THAT ANY DEFECTS WILL BE IMMEDIATELY CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMSRam OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.

9. Termination

You may terminate this agreement at any time simply by deleting Habitly from your devices and removing any associated cloud backups. We reserve the right to suspend or discontinue the application or modify these Terms at our discretion without prior notice.

10. Changes to these Terms

We reserve the right to modify these Terms at any time. When updates are published, the revised Terms will be posted to this URL with an updated Effective Date. Continued use of Habitly following such revisions constitutes your acceptance of the new Terms.
